These terms and all information here has no relevance to any images found on our website for reuse.
Copyright and usage
Are there any restrictions on images delivered?
No.
As far as we’re concerned, if you’ve paid us to carry out a flight, you can do whatever you want with the images we deliver, regardless of the intention stated when booking. We impose no time or usage limits. You can even use them in any advertising or grant reproduction rights to a third party without our permission.
Who owns the copyright to images delivered?
The entire copyright, title, and intellectual property rights of any images belong to us, but you have a permanent royalty-free licence to use or distribute the images delivered as you see fit.
Our right to a credit
The Copyright, Designs and Patents Act 1988 grants us the right to be credited as ‘DronePics.Wales’ where the images are used, when possible. However, we agree not to claim this right for any images of domestic properties.
We’ll also waive this right on a case-by-case basis for commercial projects.
Will we use the images delivered?
We might use images delivered to you or otherwise taken during your flight for the promotion of our company, either on our social media feeds or elsewhere.
Booking and delivery
Booking
You’ll need to complete a booking form, usually via email or via our website as a self-service booking. We’ll request a £20 holding deposit at this stage, along with any relevant information or instructions about the job. Your timeslot is then secured.
On the day
We’ll assess the weather conditions and confirm if your flight can take place as planned.
For ‘morning’ or ‘afternoon’ bookings, we’ll be in touch with an exact time at least an hour beforehand.

Cancellation and Postponement
Bad weather
We can’t fly at all in rain or strong winds, and even moderate winds can make it unsafe to carry out a close-up roof inspection.
We’ll assess the forecast on the day of the job and let you know if it’s going ahead. During the winter, we keep even more time free for rescheduled jobs, so if we decide conditions are unsuitable we’ll get you rebooked as soon as possible. Alternatively, your deposit can be refunded at your request.
If agreed at the time of booking, we can schedule jobs for specific conditions, such as a sunny or snowy day. However, in all other circumstances, we’ll carry out the job if we consider the lighting sufficient to deliver clear images and if we consider the conditions safe to fly.
If you need to postpone
We won’t charge you a fee for rescheduling.
If you want to cancel
Your deposit will be returned in full if cancelled at least 7 days before the booked date. Otherwise, it may be retained by us. You won’t become liable for any amount above your deposit until the flight commences, at which point you become unable to cancel and full payment will be required.
If we can’t make it
If we’re unable to attend on the booked date due to any cause beyond our reasonable control (e.g. sudden illness, injury, victim of crime, flooding, covid self-isolation) we’ll endeavour to rebook your flight as soon as possible. Alternatively, you’ll be entitled to an immediate refund of your deposit at your request.
In the event of such cancellation, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid to the Photographer by the Client at that time.
Rejection of images delivered
Unless a rejection fee is agreed in advance, there is no right to reject the images delivered on the basis of style or composition. In such circumstances, payment of the rejection fee instead of the full quoted price forfeits your rights to use or distribute any images delivered.
Payments
Payment methods
For self-service bookings via our website, we’ll usually take a card payment for your deposit. For all other payments, we’ll usually provide our sort code and account number so you can pay via bank transfer. However, we can take any payments via credit or debit cards, via Paypal or in cash if you prefer.
Late payments
You’ll receive an invoice and payment request alongside your delivered images. If we haven’t received full payment within 30 days of this date the payment becomes late and overdue, unless previously agreed in writing.
The Photographer reserves the right to charge interest at the rate prescribed by the Late Payment Of Commercial Debts (Interest) Act 1998 from the due date until the date payment is made.
If any invoice issued to the Client is not paid by the Due Date, then all unpaid invoices issued to the Client become due with immediate effect, even if it is less than 28 days from the issue date, and that The Photographer may consider these invoices as overdue when pursuing legal action for the recovery of said debts.
Client confidentiality
Any information disclosed to us in the course of our work will be kept confidential and will not be disclosed to any third parties.
Liability and Indemnity
It is the Client who must satisfy him/herself that all necessary rights, model releases or consents which may be required for reproduction, are obtained and it is acknowledged that we give no warranty or undertaking that any such rights, model releases or consents have been or will be obtained whether in relation to the use of names, people, trademarks, registered or copyright designs or works of art depicted in any picture. In the event that the Image/video issued or reproduced by or with the authority of the Client does not have the necessary rights, releases or consents, then the Client shall indemnify The Photographer against all expenses, damages, claims, or legal costs arising out of any such failure.
Image storage
All final images will be stored and archived by The Photographer for 60 days. If archived photographs are required after that time or additional storage time is required, an admin fee may be charged. The Photographer will also provide a branded USB copy of the work. If the Photographer loses images/videos stored in archive or they are stolen, The Photographer is not liable beyond 60 days of storage. Within 60 days, The Photographer is liable to the cost of the originals (a return of the original fee).
Applicable Law
This agreement shall be governed by the laws of England and Wales, and by the CAA & drone code.

Distraction
Once drone operations have started, the client must not interfere on a current drone shot unless instructed otherwise. Once the drone has been deemed in a safe location, the Client will be made aware, and changes can take place.
Emergencies
If any drone loses control, the Photographer/Operator will shout “FAIL”, and the client must avoid the drone. The Client must never approach the drone during take-offs and landings.
Safety
Upon arrival at the job, a safety brief and risk assessment will take place before commencing any work.
